Riddle me this: What has this man been doing in prison all these years when his cell could have been occupied by some of the dangerous convicts we are told walk free every year because there is not enough prison space to house them?

this makes a point i have tried to make in other contexts: there is virtually no correlation between “time” and “crime”; our obsession with trying to find one is disasterous. most crimes are fundamentally “economic” (e.g., theft, robbery) or “physical” (e.g., assault). if punishment should fit the crime, that means we should reconsider our negative attitudes toward fines and coerced labor for the one set, and physical punishment for the others. won’t THAT raise an uproar.
VANCOUVER (CP) – A former hotel worker pleaded guilty Wednesday in provincial court to 10 sexual offence charges, including seven stemming from incidents involving children overseas.
Before the guilty pleas were entered, Donald Bakker was the first person to potentially face a trial under a so-called sex tourism law enacted in June 2002.
Bakker pleaded guilty to one count of sexual assault and two counts of sexual assault causing bodily harm involving three prostitutes in Vancouver. He also pleaded guilty to seven counts of sexual interference on children under the age of 14 in southeast Asia.
Bakker’s lawyer, Kevin McCullough, and the Crown prosecutor made a joint submission to the judge for a 10-YEAR PRISON SENTENCE, said Stan Lowe, a spokesman for the Crown attorney’s office.
Bakker has already served 18 months in jail and that time would count for double, meaning he would face seven more years in jail if the judge accepts the joint sentencing submission from the defence and the Crown.
The judge adjourned Bakker’s sentencing hearing until Thursday.
Bakker, who is in his early 40s, was facing 22 charges before Wednesday’s guilty pleas involving adult prostitutes and another 16 charges related to Asian children.
He was arrested in December 2003 at a park on the Vancouver waterfront after police spotted a man emerging from bushes followed by a distressed sex-trade worker.
Police seized videotapes after they arrested Bakker and said they contained disturbing images filmed in Vancouver and southeast Asia.
Bakker had sought to have the charges separated into two trials – one on the charges in Canada, the other involving the charges overseas – before the guilty pleas.
Kevin McCullough, Bakker’s lawyer, said the case has been difficult for his client to deal with.
“He’s stunned by what he has done,” McCullough told the court. “He wishes to tell the court he will never be in court again.”
Bakker was visibly shaking during the court hearing.
“He’s had a rough ride,” said McCullough, adding that the case has caused a “great deal of pain for his wife and child.”
The federal law aimed at stopping sex-crime tourism permits Canada to prosecute sex offences committed by a Canadian in a foreign country, regardless of that country’s own laws or its ability to pursue foreign pedophiles.
Another problem with giving relatively soft criminals hard time is that the prolonged amount of time behind bars just gives them nothing to do but pump iron and learn from the really hard cases. We might be making more monsters instead of reforming them.
One of the previous stories about the denial of this man’s parole mentioned something about “prison infractions”, which I assume means breaking prison rules. Mention is also made of a long stay in maximum security, so it is possible that this fellow was not exactly a model inmate. You have probably heard of time off for “good behavior”. It works the other direction, also – time added for bad behavior.
On it’s face, though, it seems excessive. Local prosecutors don’t generally take a keen interest in freeing prisoners just for the heck of it, either.

As to the cases that Shannon posted, I agree wholeheartedly, but have you considered the addmitedly unlikely possibility that he was telling the truth and was regretting it? Unlikely…but possible. But real regret is hard to fake and even harder to verify. As to your outrage at the lawyer’s comment that he had a ‘rough ride’, he might have had one. Or he might be lying through his teeth. Again, pity usually rules out and it seems that some judges would rather appeal to criminal’s better natures rather than tossing them in jail.

Lot of things to consider when judging ANY case. Best give benefit of doubt in retrospect (or when you don’t have any authority) but judges should try to verify whether someone is really regretting it and judging based on that and the crime.
